2. Who We Are

The Site is operated by David Mercier, a real estate salesperson licensed in California, DRE #02096621, affiliated with First Team Real Estate, CA DRE #01008773. All real estate services offered through this Site are provided under the supervision of First Team Real Estate.

3. Informational Purpose Only

Content on the Site is provided for general informational purposes. It is not legal, tax, financial, investment, or appraisal advice, and it is not a substitute for professional advice specific to your situation. You should consult an attorney, tax professional, lender, or licensed appraiser before making decisions about real property.

4. Calculators, Estimates, and Valuations

The Site offers tools including a home value estimator, mortgage calculator, rent estimator, investment analyzer, equity estimator, and the Next Move Quiz. These tools:

• Produce estimates based on assumptions, public data, and information you supply
• Are not appraisals, broker price opinions, or offers to purchase
• May be inaccurate, incomplete, or out of date
• Should not be relied on as the sole basis for any financial or real estate decision

Actual property values, rents, loan terms, and returns will differ. We make no guarantee as to the accuracy of any output.

5. The Dream Home Club

The Dream Home Club is a free membership program. When you join, you create an account and provide information about your goals, finances, and timeline. You agree that:

• Information you provide is true and accurate to the best of your knowledge
• You will keep your login credentials secure and are responsible for activity under your account
• We may contact you about your membership, your plan, and related real estate services
• We may suspend or terminate membership at our discretion
• Membership does not create an agency relationship. A real estate agency relationship is formed only through a signed written agreement.

6. Communications Consent

By submitting your contact information through any form on the Site, you consent to be contacted by David Mercier and First Team Real Estate by phone, email, and text message regarding real estate services, including through automated or prerecorded means where permitted. Consent is not a condition of any purchase. Message and data rates may apply. Message frequency varies. You may opt out of text messages by replying STOP, or unsubscribe from email using the link in any message. You certify that the phone number you provide is your own.

7. Intellectual Property

The Site's content, including text, graphics, logos, photographs, and software, is owned by David Mercier or used under license, and is protected by copyright and trademark law. The REALTOR® mark is a registered collective membership mark of the National Association of REALTORS®. The First Team name and marks are the property of First Team Real Estate. You may view and print content for personal, non-commercial use. You may not copy, republish, redistribute, scrape, or use the content commercially without written permission.

8. Third Party Services and Links

The Site links to and embeds third party services, including RealScout for property search and other providers for scheduling and communications. We do not control those services and are not responsible for their content, accuracy, or privacy practices. Your use of a third party service is governed by that provider's terms.

9. Property Listing Data

Where listing information appears on or through the Site, it is sourced from a multiple listing service and is subject to that MLS's terms. Listing data is deemed reliable but not guaranteed accurate. It is provided for your personal, non-commercial use, solely to identify properties you may be interested in purchasing. Independently verify all information.

10. Fair Housing

We are committed to the letter and spirit of United States policy for the achievement of equal housing opportunity. We do not discriminate on the basis of race, color, religion, sex, sexual orientation, gender identity, national origin, familial status, source of income, disability, or any other protected characteristic.

11. No Warranty

12. Limitation of Liability

To the fullest extent permitted by law, David Mercier and First Team Real Estate will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, data, or opportunity, arising out of your use of or inability to use the Site or any tool or content on it. Where liability cannot be excluded, it is limited to the greatest extent permitted by law.

13. Indemnification

You agree to indemnify and hold harmless David Mercier and First Team Real Estate from any claims, losses, and expenses, including reasonable attorneys' fees, arising from your misuse of the Site or your violation of these terms.

14. Governing Law

These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute will be brought exclusively in the state or federal courts located in Orange County, California, and you consent to that jurisdiction.
